Sudan TPS Protection Continues Pending USCIS Announcement

USCIS now says that Sudanese individuals in the United States under Temporary Protected Status keep their TPS protection. This includes work authorization. The agency is preparing another announcement. That alert answers the immediate question facing families after October 19, 2026. Protection continues while the agency prepares and issues its announcement.

This is general legal information, not individualized legal advice. A person with Sudan TPS who has a pending application, an employment authorization problem, or another immigration case should review the facts with immigration attorneys. What did USCIS announce about Sudan TPS?

An alert on the USCIS Sudan TPS page states that an announcement on Sudan’s TPS will be made at the appropriate time. Until such announcement is made, Sudanese individuals present in the United States under TPS retain protection, including work authorization.

An announcement on Sudan’s TPS will be made at the appropriate time.

The current alert matters because the same page contains earlier TPS designation information. That information includes an earlier continuation date of October 19, 2026. That date is now historical context. It is not the end of the protection described in the alert. Families should not assume that the calendar date alone ended their current TPS protections.

The most recent Federal Register extension listed on the page is 90 FR 5944, published January 17, 2025. That notice set a re-registration period from January 17, 2025 through March 18, 2025. That re-registration period has closed. USCIS also lists prior Sudan notices at 88 FR 56864, 87 FR 23202, 85 FR 79208, 86 FRN 50725, and 87 FR 68717.

The alert states that protection continues for Sudanese individuals present in the United States under TPS, including work authorization, until USCIS makes an announcement about Sudan's TPS.

Who keeps Sudan TPS protection and work authorization?

The USCIS alert covers a specific group: Sudanese individuals present in the United States under TPS. Those people keep protection, including work authorization, until USCIS makes its announcement. TPS is a temporary immigration protection. It does not by itself create lawful permanent resident status.

Until such announcement is made, Sudanese individuals present in the U.S. under TPS retain protection including work authorization.

The alert directly addresses people who already have TPS. It should not be read as an automatic grant of TPS to every Sudanese national in the United States. Earlier Sudan TPS eligibility information on the page identifies continuous residence in the United States since August 16, 2023. It also identifies continuous physical presence since October 20, 2023. Those dates came from the prior designation framework.

USCIS also describes a separate process for Employment Authorization Documents, called EADs. An EAD is a document that shows employment authorization. USCIS says it will send a notice about an EAD extension to a person who remains eligible for TPS and whose TPS-based Form I-765 is still pending. Form I-765 is the application for employment authorization. The page identifies category codes A-12 and C-19 for TPS-based EADs.

That EAD guidance was connected to the earlier October 19, 2026 designation period. The current alert confirms that TPS protection and work authorization continue while USCIS prepares its announcement. It does not make every older card date or prior EAD notice interchangeable. Keep the original EAD, every USCIS notice, and copies of all filed forms together.

In our experience, TPS holders first ask whether an expired-looking work card changes the protection they already have. The answer may depend on the person's TPS record. It may also depend on the category on the EAD, any pending Form I-765, and the current USCIS notice.

Why employment records matter

Work authorization is expressly included in USCIS's alert. People should preserve the written alert and their individual USCIS correspondence. Employers and benefit agencies may review documents under their own verification processes. Clear records can prevent avoidable confusion.

What law governs Sudan TPS and asylum timing?

The Sudan TPS page identifies the country's designation history and the relevant Federal Register notices.

The Sudan TPS page provides information about protection and work authorization for Sudanese individuals present in the United States under TPS, as well as links to other immigration options and related resources.

One important rule concerns asylum timing. Federal regulation 8 CFR 208.4(a)(5)(iv) treats a grant and maintenance of TPS until a reasonable period before an asylum filing as an extraordinary circumstance. This can matter for the asylum one-year filing deadline. USCIS explains that TPS can stop the clock if the one-year clock had not already expired.

Being granted and maintaining TPS until a reasonable period before the filing of the asylum application is considered an extraordinary circumstance for the purposes of the one year filing deadline. In other words, having TPS “stops the clock” on the requirement to file for asylum within one year of arriving in the United States, if the one-year clock has not already expired. Other paths can remain available

USCIS notes that TPS holders may qualify for other immigration options. These options can include a lawful permanent status category if the person meets its requirements. A family petition, humanitarian protection request, or another immigration filing has separate eligibility rules. Readers evaluating asylum procedures can also review our discussion of the asylum process and immigration hearings.

What should Sudan TPS holders do now?

Start by making a complete TPS file. Gather your Form I-821 receipt or approval notices, EADs, Form I-765 receipts, USCIS extension notices, passport identity pages, and every USCIS letter. Save electronic copies in a secure location. Keep the originals where you can reach them.

Next, confirm your account information in myUSCIS if you have an account. USCIS says it sends certain EAD extension notices by mail. It also sends them electronically to people with myUSCIS accounts. A correct mailing address helps make sure that a future notice reaches you.

Then, review each EAD document carefully. Check the category code, expiration date, and any related USCIS notice. Do not throw away an older EAD or notice just because the card date has passed. The complete set of documents may matter to a workplace or benefits agency.

Finally, consider whether another immigration option fits your situation. USCIS directs people to its Green Card Eligibility Categories page to identify a category that may fit their situation, then to the relevant link for eligibility and application information. Family-based immigration, asylum, and humanitarian relief each require separate analysis. Our nationwide immigration legal team can evaluate how TPS relates to another immigration filing.

Watch for unauthorized assistance

USCIS warns that unauthorized practitioners may claim they can file TPS forms for payment. USCIS says immigration legal advice may be given by an attorney. It may also be given by an accredited representative working for a Department of Justice recognized organization. Ask who is authorized to provide advice before sharing documents or money.

What should I watch for next?

The next important development will be USCIS's announcement about Sudan TPS. The agency's Temporary Protected Status Designated Country: Sudan page is the official page to watch for that update.

Until USCIS makes the announcement, its alert states that protection continues for the TPS holders it covers. Sudanese individuals present in the United States under TPS keep protection, including work authorization. Check the country page regularly. Do not rely only on social media posts, old screenshots, or a calendar reminder tied to the earlier date.

It is not yet settled whether a future USCIS announcement will create a new registration process, change documentation procedures, or set a later TPS date. The practical response is preparation, not panic. Keep documents current. Keep proof of your TPS history. Get qualified legal advice before changing work or immigration plans.

Frequently Asked Questions

Does Sudan TPS continue after October 19, 2026?

Yes, for Sudanese individuals present in the United States under TPS, USCIS says protection, including work authorization, continues until the agency makes an announcement on Sudan TPS.

Can I keep working with Sudan TPS?

USCIS expressly says that people covered by its Sudan TPS alert retain work authorization. Individual EAD documentation can still matter in workplace verification. Keep your EAD, TPS notices, Form I-765 materials, and any USCIS extension notice. Case-specific review is wise if an employer questions your documents.

Can TPS help with the asylum one-year deadline?

Being granted and maintaining TPS until a reasonable period before the filing of the asylum application is considered an extraordinary circumstance for the purposes of the one year filing deadline. In other words, having TPS “stops the clock” on the requirement to file for asylum within one year of arriving in the United States, if the one-year clock has not already expired. Should I submit a new TPS application now?

The prior Sudan TPS re-registration period ran from January 17, 2025 through March 18, 2025, and it is closed. USCIS's current alert confirms continuing protection while an announcement is pending. Review the next USCIS announcement before filing anything based on a future instruction.

Can TPS lead directly to a green card?

TPS itself is temporary protection, not a direct green card category. USCIS notes that a person may seek lawful permanent status if eligible under one of the Green Card Eligibility Categories. A family relationship or another independent immigration category may create a separate path, subject to its own requirements.

Where can I verify Sudan TPS news?

Check USCIS's Sudan country page, which carries the current alert and links to TPS forms and related information. USCIS updates are more reliable than unverified posts. Save a dated copy of the page and any USCIS notice that applies to your own application or EAD.
